Terms of Use

Effective Date: May 18, 2026. Operator: JustBe Media LLC ("AlwaysBeMe," "we," "us," "our").

These Terms of Use ("Terms") govern your access to and use of the AlwaysBeMe website, coaching programs, digital products, merchandise, and related services (collectively, the "Services"). By using the Services or purchasing from us, you agree to these Terms. If you do not agree, do not use the Services.

1. Eligibility

You must be at least 18 years old, or 13-17 with verifiable parent or guardian consent, to use the Services. By using the Services, you represent that you meet this requirement.

2. Accounts

If you create an account, you are responsible for keeping your credentials secure and for all activity under your account. Notify us promptly if you suspect unauthorized use. We may suspend or terminate accounts that violate these Terms.

3. Coaching Programs

Coaching is provided for personal development, performance, and mindset purposes. It is not therapy, medical advice, or a substitute for licensed mental-health, medical, legal, or financial care. Results vary and we make no guarantees regarding athletic, academic, financial, or personal outcomes. You remain responsible for decisions you make based on coaching. You agree to attend scheduled sessions on time. Missed sessions are forfeited unless rescheduled in advance per the program's stated rescheduling policy.

4. Digital Products (Ebooks, Downloads, Courses)

Digital products are licensed for your personal, non-commercial use. You may not redistribute, resell, share login credentials, post the content publicly, or use it to train AI models. Violation may result in termination without refund.

5. Merchandise and Jerseys

Physical goods (including jerseys and apparel) are sold subject to availability. Title and risk of loss transfer when the carrier accepts the package. Sizing, colors, and customization details shown online are approximate; minor variations are not defects.

6. Payment

Prices are in U.S. dollars unless stated otherwise. You authorize us (or our payment processor) to charge your selected payment method for the total due, including applicable taxes and shipping. Failed or reversed payments may result in suspension of access until resolved.

7. Refund Policy

Coaching programs. You may request a full refund within seven (7) days of your purchase date (not from your first session). After day seven, all sales are final. Refunds inside the window are full refunds only - we do not prorate based on sessions used. This window is measured from purchase to prevent it from being extended by delaying program start.

Physical merchandise and jerseys. You may return items within fourteen (14) days of delivery, unworn and unwashed, in original condition with tags attached. You are responsible for return shipping. Refunds are issued after we inspect the returned item. Custom or personalized items (e.g., name/number jerseys) are non-refundable except for manufacturing defects.

Ebooks and downloaded digital products. No refunds once a file has been downloaded or course content has been accessed.

Chargebacks. If you initiate a chargeback that is later resolved in our favor, we may suspend your account and recover related costs.

8. SMS and Marketing Communications

If you opt in to SMS messages, you give prior express written consent to receive marketing and transactional texts from AlwaysBeMe at the number you provide, including messages sent using automated technology. Consent is not a condition of purchase. Message and data rates may apply. Message frequency varies. You may opt out at any time by replying STOP to any message. STOP works on all of our marketing messages. Reply HELP for support, or contact us using the information below. You also have the right to revoke consent at any time by replying STOP or by emailing us at the address in Section 16. We aim to comply with the federal Telephone Consumer Protection Act (TCPA) and, because we are operated under Florida law, the Florida Telephone Solicitation Act (FTSA). Florida residents specifically: you must give prior express written consent before receiving marketing texts or autodialed calls, and STOP requests are honored on all messages.

9. Acceptable Use

You agree not to: (a) violate any law or third-party right; (b) scrape, reverse engineer, or interfere with the Services; (c) upload malicious code or attempt to bypass security; (d) harass other users, coaches, or staff; (e) impersonate others; or (f) use the Services to send spam.

10. User Content

You retain ownership of content you submit (testimonials, photos, messages in coaching, etc.). You grant us a worldwide, royalty-free license to host, display, and use that content to operate and promote the Services. You confirm you have the rights to grant this license. You can ask us to remove your testimonial or photo at any time by emailing us.

11. Intellectual Property

The Services, including our coaching frameworks, written materials, audio, video, logos, and brand assets, are owned by JustBe Media LLC or our licensors. You receive only the limited license described in these Terms. All other rights are reserved.

12. Third-Party Services

The Services may link to or integrate with third-party platforms (payment processors, scheduling tools, fulfillment partners, the Wix platform). We are not responsible for third-party services. Your use of them is governed by their own terms.

13. Disclaimers

The Services are provided "as is" and "as available." To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or produce specific results.

14. Limitation of Liability

To the maximum extent permitted by law, our total liability for any claim arising out of or related to the Services is limited to the greater of (a) the total amount you paid to AlwaysBeMe / JustBe Media in the twelve (12) months before the event giving rise to the claim, or (b) one hundred dollars ($100). We are not liable for indirect, incidental, consequential, special, exemplary, or punitive damages, or for lost profits, lost data, or loss of goodwill. Some jurisdictions do not allow these limits; in that case, our liability is limited to the smallest extent permitted by law.

15. Indemnification

You agree to indemnify and hold harmless JustBe Media LLC and its officers, employees, and contractors from claims arising out of your breach of these Terms, your User Content, or your misuse of the Services.

16. Dispute Resolution

Informal resolution first. Before filing a lawsuit, you agree to contact us at hello@alwaysbeme.com and give us thirty (30) days to resolve the dispute informally. Most issues can be solved this way. Courts. If informal resolution fails, disputes will be brought exclusively in the state or federal courts located in the State of Florida, and you consent to personal jurisdiction there. We are not requiring arbitration, and nothing in these Terms waives your right to participate in a class action.

17. Governing Law

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-laws rules.

We may update these Terms; material changes will be posted with a new Effective Date. We may suspend or terminate access for violation of these Terms.
